What are the standards and durations for entry restrictions (entry bans) for immigration offenders?

Today, we will look into the duration one has to wait to re-enter South Korea after being deported due to a violation of immigration laws or other laws. Specifically, we will explore the standards and periods of entry restrictions (entry bans).

Firstly, the entry restriction system refers to a system where entry is prohibited for a certain period (from 6 months to 10 years) depending on the severity of the legal violation.

I will post about the general entry restriction (entry ban) periods for these legal violations.

※ However, these standards are not absolute. There are principles of reciprocity between countries regarding entry restrictions, and there are also humanitarian reasons.



Entry Restriction for 1 Year

1. Individuals fined between 5 million and 10 million won for criminal offenses. 2. Individuals who worked illegally - Working outside the designated workplace - Engaging in activities outside of residency qualifications. 3. Individuals who stayed illegally for a period between 6 months and less than 1 year 4. Individuals fined between 5 million and 7 million won for violations


Entry Restriction for 2 Years

1. Individuals fined between 10 million and 20 million won for criminal offenses

2. Individuals who stayed illegally for a period between 1 year and less than 3 years

3. Individuals fined between 7 million and 10 million won for violations


Entry Restriction for 3 Years

1. Individuals fined more than 20 million won for criminal offenses 2. Individuals who stayed illegally for a period between 3 years and less than 5 years 3. Individuals fined more than 10 million won for violations


Entry Restriction for 5 Years

1. Individuals sentenced to imprisonment or jail for less than 5 years for criminal offenses (including suspended sentences)

2. Individuals who violated immigration laws, such as

- Staying illegally for more than 5 years

- Entering the country with a false invitation

- Individuals who violated prohibitions by providing means to secure debt performance, such as the foreigner registration card

- Individuals who violated prohibitions by providing ships or etc.

- Employing, brokering, or encouraging violations of the Immigration Control Act

3. Individuals who moved foreigners from Jeju region to other regions without permission or those who facilitated such movement

4. Individuals who used false official documents related to immigration or those involved in aiding and abetting.


Entry Restriction for 10 Years

1. Individuals sentenced to imprisonment or jail for 5 years or more for criminal offenses (including suspended sentences) 2. Individuals who violated immigration laws, such as - Entering the country without immigration inspection - Leaving the country without exit inspection - Using a pseudonym passport to conceal entry restrictions, entry denials, illegal stays, etc - Individuals protected under the Immigration Control Act who escaped during protection or during escort for forced deportation 3. Individuals forcibly deported at the expense of the state 4. Individuals who moved groups of people from Jeju Special Self-Governing Province to other regions in South Korea without obtaining permission for expanded residency areas or provided ships.


Permanent Entry Restriction

1. Individuals who received a deferred prosecution or higher for criminal offenses

- Crimes of insurrection or treason

- Crimes of murder, rape, or robbery

- Sexual violence crimes, drug crimes, violations of the Act on Special Cases Concerning the Punishment, etc., of Specific Crimes

- Violators of the National Security Act

- Violent criminals and other serious offenders
